Terms & Conditions
The General Terms and Conditions (GTC) apply to all contracts, deliveries and other services from KANTE - Fine Art Interior, owner Katharina Trnka, hereinafter referred to as "the seller" to the customer, hereinafter referred to as "the buyer". The sale (order) between the seller
KANTE - Fine Art Interior / Katharina Trnka , Spazgasse 11, 4040 Linz, firstname.lastname@example.org
and Buyer shall be governed by these General Terms and Conditions ("GTC") with respect to goods manufactured or commissioned by Seller or purchased from third parties (hereinafter the "Goods") to the exclusion of any prior oral or written agreements. Austrian substantive law applies to the order to the exclusion of the UN Sales Convention. Place of fulfillment is Linz.
Order & conclusion of the contract
The order and contract between the seller and the customer for the purchase of goods comes through when the buyer fills out and sends the inquiry form (= non-binding inquiry), through the agreement and submission of a non-binding offer by the seller and through the written confirmation of the offer the buyer and the agreed performance of a down payment by the buyer. The confirmation is sent to the buyer by email. After personal consultation with the seller, the buyer receives a confirmation of the order with all order data by e-mail. An order can only be completed with an adult.
Right of return and cancellation
The buyer has the right to revoke this contract within fourteen days without giving reasons. The cancellation period is fourteen days from the day on which the buyer took possession of the goods. In order to make use of the right of withdrawal, a clear statement (e.g. a letter sent by post or an e-mail) must be sent to the above contact details of the seller and inform about the decision to withdraw from this contract. To meet the cancellation deadline, it is sufficient to send the communication regarding the exercise of the right of cancellation before the cancellation period has expired. If the contract is revoked, the goods are already with the buyer and have been paid for, the buyer is obliged to return the goods to KANTE - Fine Art Interior immediately and in any case not later than fourteen days after the cancellation of this contract. The deadline is met if the goods are sent before the period of fourteen days has expired. The buyer bears the cost of returning the goods. The buyer is only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods. KANTE - Fine Art Interior is obliged to return the full purchase price to the buyer within fourteen days of receipt of the cancellation of the contract at the latest (excluding the return shipping costs, which the buyer bears himself). The same payment method used for the purchase will be used for this refund. Under no circumstances will additional fees be charged. KANTE - Fine Art Interior can refuse the repayment until the goods have been sent back or at least until proof of postage of the return has been provided.
Prices and shipment
Due to the small business regulation applicable here in accordance with Section 19 of the Value Added Tax Act (UStG), no VAT is shown. The goods ordered by the buyer - if they are in stock - will be delivered to the delivery address specified by the buyer within 8 weeks AFTER full payment has been received. In the case of goods or custom-made products that are not in stock and have to be planned, produced and ordered by the seller, the delivery is individually agreed and recorded in writing. Delivery times are non-binding. KANTE - Fine Art Interior delivers free of charge throughout Austria. For deliveries outside Austria, individual delivery costs are calculated depending on the destination country per order.
Payment and retention of title
The goods are paid for in advance. After full payment has been received, the ordered goods will be delivered to the delivery address specified by the buyer within 8 weeks. The goods remain the property of the seller until full payment has been made by the buyer.
In the case of defective goods, the buyer is entitled to a monetary replacement on condition that the defective goods are returned within 14 days of delivery.
The seller is only liable to entrepreneurs for intent and gross negligence, but not for slight negligence. Liability for slight negligence is also excluded with regard to consumers, provided that personal injury is not involved. Any liability, with the exception of liability for intent, is limited to the amount of the purchase price of the goods. The seller is not liable for damage not caused to the goods themselves; in particular, the seller is not liable for lost profits or other financial losses of the buyer.
Should individual provisions of this contract (GTC) be or become invalid, the validity of the contract remains valid and unaffected. The invalid provision is to be reinterpreted or supplemented or replaced in such a way that the intended economic purpose is achieved as far as possible.
